EXIT Realty Foothills Informs about New Smoking Law
State Now Allows Smoking Ban in Multifamily Housing
La Verne, CA (Grassroots Newswire) 1/3/2012 -- This past Sunday, January 1, 2012 a new smoking law went into effect. The new law now gives landlords of multifamily housing the right to restrict smoking. Senator Alex Padilla, writer of the California Senate Bill 332, said “we will see the availability of smoke-free, multifamily housing grow throughout California.” The bill was signed by Gov. Brown on September 6.
Landlords already had the right to restrict pets, noise and water furniture, and now have legal right to restrict smoking in their units. Many property-owners already had this restriction but this bill gives them support. The law requires that the landlord must specify in the lease/rental agreement where smoking is prohibited.
Bill 332 was presented with a multitude of health studies showing the effects of secondhand smoke in multifamily dwelling. The most significant study was that of the 2010 study done by The American Academy of Pediatrics showing that children were predominantly the ones harmed by the second hand smoke in multifamily homes.
"While more than 86 percent of Californians do not smoke, there is currently very little smoke-free housing in California," Padilla said. "Living in multifamily housing should not compromise the health of renters or their children."
Padilla wanted to ensure that smoking restrictions were specifically dealt with even though there was not much opposition to landlords who already include this restriction on their tenants.
